In this regard, this blog introduces you to yet another training video titled “Creating Long Term Value & Risk Mitigation With Ghostwriting.” By way of backdrop, if you have worked with Miletti Law®, you may have noted that we have always tried to provide non-traditional legal services not seen every other day, which is a unique aspect of the services we provide as a law firm. Normally, most people opt for a “slip & fall” or an “ambulance chaser” kind of attorney who would robotically keep on trolling, suing, and collecting every breadcrumb to fight through an ongoing litigious process. In the traditional realm of such legal services, the attorney on the defense side falls purely on the hourly rate, while the one on the plaintiff’s side turns into some hybrid of a retainer and hourly with some contingency at hand.

As a law firm, Miletti Law® strives to provide alternative approaches to legal services that are not standard for more attorneys. To this end, Mr. Vinny Esq., the law firm’s legal champion, is keen on providing other services such as profuse SEO (search engine optimization), marketing for attorneys, and legal branding as a way of optimizing the value clients get. Most business owners can agree with us that every single business needs an in-house counsel, but the highest percentage cannot afford one because, for one, such a counsel would generally cost $300,000 a year. Once you email the attorney what you wish the client to know about the dismissal, the attorney takes up the task of repackaging and modeling your message into an organized and legally informed letter to be sent to the employee. As a legal expert, the attorney knows and is able to anticipate the issues that would arise down the road, which should be incorporated into the letter. The ghostwriter is also capable of using language that would stimulate and provoke a response from the employee, but for which a contingency plan would be put in place beforehand.

Usually, ghostwriting involves drafting articles, emails, and contract negotiations, not to mention hiring and dismissal letters, as in the example provided above. However, the employer should have, on the inside, a trusted individual who understands the legal risks involved, the nature of the business, and what would be at stake following such a move. Assume that as a manager, you are used to writing to a board of directors directly but then start using a ghostwriter to do the same. You are right to question whether, after using a ghostwriter’s services, the board would recognize your voice, and understand your perspective in regards to what you needed to communicate. The answer is yes, and the process does not involve deception. It is just that an expert in ghostwriting and a great ghostwriter knows perfectly well how to tune your message such that, despite using legal terminologies and quoting statutes, it would absolutely and unreservedly reflect how you would have written in your style, but with a few legal patches to set things straight in the face of the law. Well, it is agreeable that such might seem a bit complex for a layperson to understand, but an expert would make it smooth and friendly for everyone to understand. Funny, Vinny frequently uses the term “indemnification” in such writing and jokes about no one knowing what it means – well, probably except me, the legal writer and publisher.
