In today’s installment of the Miletti Law Blog, Tales of the Unusually Motivated, we address a recurring problem in the world of intellectual property law… TROLLSSSS!!!!
Yes, we have Trolls among us– for those of you who do not know– the term “Troll” refers to those who “deliberately piss you off online, simply to get a reaction” (see https://www.urbandictionary.com/define.php?term=Troll). In the world of law, a Troll Firm or Troll Agency would be that particular entity who sends you those random emails out of nowhere, with claims such as:
- Our client, Mr. A. Jerkoff, owns the copyright to the following image (with no reference to any registration number) and you are infringing on his rights.
- Our client, Ms. See You Next Tuesday, owns the trademark registration to a PIECE OF SHIT BRAND, and your 1(b) application in [TOTALLY DIFFERENT BRAND] is inherently confusing, and causing damages on her brand (meanwhile, you haven’t even used it once, you basically just registered the name for “intent to use”.)
or, my personal favorite:
- Our client, SHIT MUSIC PRODUCTIONS, owns the copyright to a song you are publishing on youtube (with no channel listed, no name, no link, nothing at all). Please call us so we can discuss this willful infringement.
Surely, if you own a business, and published anything in your life, you certainly have been reached out to by a prominent Troll Firm or Agency. Hell, I can name a few off the top of my head:
- Richard Liebowitz. Sources have told me that this guy has filed over 3,000 copyright infringement cases since 2015 alone. It is my understanding he settles for $5,000 on average. Funny, because that number is really just a reflection of people’s comfort zones– they are happy to resolve for $5,000 to “make it go away”
- Pixsy, Inc. The very definition of a Copyright Troll. These guys have the greatest poker face in the world. Only Pixsy can say with a straight face that you have been infringing their clients copyright, who originally took this single picture of 2 palm tree, in Ni’ihau, Hawaii, and as such, for using that 1 single picture of 1 single palm tree, you own them $4,500 per year of a license fee.
- Copypants, Inc. Another Pixsy-type of company who is known for literally sending thousands of letters alleging copyright infringement. Unlike Pixsy, these guys allegedly go for big dollars– rumor in the legal community was that these guys sent someone a demand for $150,000 for a single picture in a non-monetized movie review.
So in 2020, while the rest of the world was in a recession, with global lockdowns, with no one one working, unemployment rates literally in double digits, and the global economy coming to a halt– intellectual property trolls are BOOMING! Along with working remote, and technology advancing at a furious pace, Troll Firms and Agencies find themselves adapting to home life, purchasing enhanced software to increase the efficiency of the intellectual property bots, scraping websites at a savage pace, perfecting algorithms to scour the internet for just the stupidest claims.
